TERMS OF USE

These Terms of Use (hereinafter, ‘Terms’) regulate the use of SOSvirtual (hereinafter, ‘the Platform’), as the virtual e-learning education service of SOS Children’s Villages International. By accessing and using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with any of them, please do not use the Platform. The following conditions are binding for any user thereof.

1. USE OF THE VIRTUAL PLATFORM AND USERS’ OBLIGATIONS.

The user agrees to use the virtual platform, content, and services without contravening current legislation, generally accepted practices, and public order. The use of the virtual platform for illicit or harmful purposes against SOSvirtual or a third party, which in any way may cause harm or hinder the normal use of the online campus, is prohibited.

SOSvirtual ensures that the content and services offered by the portal respect the principle of human dignity, protection of youth and children, non-discrimination based on race, sex, religion, opinion, nationality, disability, or any other personal and social aspect.

These Terms of Use of the virtual platform do not grant the user any other right to use, alter, exploit, reproduce, distribute, or publicly communicate the contents of the virtual platform other than those expressly provided herein.

The content (information, sound and/or image files, photographs, designs, etc.) collected on the portal is the property of SOSvirtual and SOS Children’s Villages International, and they are duly authorized for dissemination by their legitimate owners.

As a non-profit entity, SOSvirtual undertakes not to engage in misleading advertising, and therefore, the following are prohibited:

  • Use for any commercial or advertising purposes other than those strictly permitted.
  • Reproduction, publication, distribution, or modification, in whole or in part, unless prior written authorization is obtained from their legitimate owners or is legally permitted.
  • Any infringement of the rights of SOSvirtual, SOS Children’s Villages International, or their legitimate owners thereof.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY

The user acknowledges and accepts that all industrial and intellectual property rights over the contents and/or any other elements inserted in the virtual platform belong to SOSvirtual and SOS Children’s Villages International, or they are duly authorized for dissemination through the virtual platform.

In the event that a user or a third party considers that there has been a violation of their legitimate intellectual property rights due to the introduction of certain content on the online campus, they must notify SOSvirtual of this circumstance, indicating:

  • Personal data of the interested party claiming the allegedly infringed rights, or indicating the representation with which they act in case the claim is made by a third party other than the interested party.
  • Identify the content protected by intellectual property rights and its location on the virtual platform, the accreditation of the intellectual property rights indicated, and an express statement in which the interested party assumes responsibility for the truthfulness of the information provided in the notification.

3. LINKS

The content on the Platform provides links to other websites owned and contents owned by third parties.

The sole purpose of the links is to provide the user with the possibility of accessing such links. SOSvirtual is not responsible in any case for the results that may arise for the user from accessing such links.

Any user intending to establish any technical link device from their website to the portal must obtain prior written authorization from SOSvirtual.

The establishment of the link does not imply in any case the existence of relations between SOSvirtual and the owner of the site where the link is established, nor the acceptance or approval by SOSvirtual of its contents or services.

The online campus where the link is established will not contain any trademarks, names, logos, slogans, or other distinctive signs belonging to SOSvirtual, except those expressly authorized.

4. COMPLIANCE WITH REGULATIONS

The Platform complies with the provisions of the EU Electronic Commerce Directive (Directive 2000/31/EC) and with the General Data Protection Regulation (GDPR).

5. UNILATERAL MODIFICATION AND DURATION

SOSvirtual reserves the right to modify, at any time and without prior notice, the presentation and configuration of the virtual platform, as well as these Terms of Use.

6. EXCLUSION OF WARRANTIES AND LIABILITY

SOSvirtual does not provide any warranty and is not responsible, in any case, for damages and losses of any nature that may result from:

  • The lack of availability, maintenance, and effective operation of the virtual platform and/or its services or contents.
  • The existence of viruses, malicious or harmful programs in them.
  • The illicit, negligent, fraudulent, contrary to these conditions, good faith, generally accepted practices, or public order, the virtual platform, its services, or contents, by users.

7. PERSONAL DATA PROCESSING

SOSvirtual, as stated in its “PRIVACY POLICY,” which you can consult at this link, has adopted the appropriate security levels for the data it processes and manages, incorporating all the technical means and measures at its disposal to ensure their confidentiality, prevent their misuse, loss, alteration, unauthorized access, and theft.

GENERAL PROVISIONS

Waiver: Our failure to enforce any provision of these Terms of Use strictly shall not constitute a waiver of such right or provision.

Applicable Law: These Terms shall be governed and interpreted in accordance with the laws of Austria, the country of operation of SOS Children’s Villages International, without regard to its principles of conflict of laws.
